ticketmaster sued in federal court for anti-trust violations
a news conference in new york will explain why the rock band the string
cheese incident is fighting to maintain control of its future.
denver, co august 8 =e2=80=93 on wednesday, august 6, sci ticketing, a compa=
ny owned
by the string cheese incident and madison house inc., filed a lawsuit in the
u.s. federal court in denver, colorado, claiming that ticketing giant,
ticketmaster, has monopolized the concert ticketing industry, using its
immense market power to prevent competition for the sale of concert tickets.
sci ticketing also alleges that ticketmaster has entered into agreements
with, among others, clear channel communications inc., to restrain trade in
the market of concert tickets.
on monday, august 11, at 11:00 a.m. to noon est, at the inter-continental
barclay hotel (drawing room and north parlor ii), 111 east 48th street in
new york city, a news conference will be held to explain the lawsuit, and
present the argument that fans shouldn=e2=80=99t have to suffer financially=20=
at the
hands of ticketmaster, and artists should be able to provide their own
ticketing services, thereby maintaining relationships with their fans and
controlling their own musical futures.

i just read a letter to the editor in backstreets magazine (bruce springstee=

sold seats to the recent bruce rising tour as "best seats available" in the=20=

section of giant stadium in ny (nose bleed section), leading die-hard fans t=

believe that if they didn't buy these tickets, they wouldn't get to see the=20
concert. then, weeks later, tickets were released for the better seats leav=
ing=20
people with bad seats tickets that they couldn't even sell on ebay once they=

bought the better tickets (for literally the same price). what a horrible=20
thing to do to people in order to try and sell out a tour!
this is a sore point for all the fans who wanted to see bruce. they bought=20
lousy seats, then got the opportunity to buy good seats, and the tour in new=
=20
jersey never really sold out! they couldn't even give the tickets away in t=
he=20
300 section!

a lot of auditoriums and music venue theaters have their seating
charts online (for those local events that tb doesn't sell tickets to)
when i was trying to buy tickets for the ig concert in pensacola
last year tb kept telling me that x was the best seat available and i
knew that there were better seats than that *and* that there were
better seats available. sometimes i think they try to sell off the bad
seats first. it just doesn't make sense, especially with this particular
concert where all the tickets were the same price whether you were
on the floor, on the first row balcony (where i was) or up in the nose
bleed. you would think they would try to sell the better seats first
and then work back to the worse seats. i had to do a lot of messing
around with the parameters to get the seats i wanted.

i hate them. i got crappy seats for bruce too and could only afford 2 seats
so i'm taking my younger son and not my 17 year old b/c he gets alot more
opportunites to see concerts. mine are second level directly across from the
stage.

hey all=
i posted this on the bbs also.
incredible show! i can fully declare that emily is out of her writing funk.
the song writing on the new record is amazing. we got 6 new songs, none of
which i heard before (although one or two have been played before i think).
setlist below. they were in high spirits coming out of 2 months in the
studio. the sound needed to be louder but hey, when you play in the middle
of a village (the chat institute is quite an amazing place), i guess it
can't be too loud.
i just can't believe how good the song writing is. i think this is the
record they wanted to make last time. em's songs are so much more upbeat the
and the melodies are incredible. her songwriting was good on by but nothing
like this. these songs are amazing in their rare acoustic format, most
likely will be over produced on the record, but hey, that is why we got the
acoustic tours and i have my taping gear!! :))) heh heh.
i did pulled a nice tape so be patient all as i listened to it on the way
home. it needs some fixes but its pretty clean and clear, similar to my
others. i'm going to try and turn this faster this time but it still could
be at least a month away before its available. i will post here again, no
emails yet please.

this was the best setlist i have ever seen them do. they played all the new songs and the usuals. treats were peace tonight, reunion, virginia woolf, and....finlandia (as an encore with kim richey).

had to post about a random indigo experience today. this weekend was
chicago's annual halsted street market days which is a gay friendly huge
street festival that attracts people from all over the midwest us. anyway,
they have 3 concert stages. well we were listening to this woman named
kimmie hayes play. i assume she's a local artist. she rocked out nicely.
she introduces one of her songs as a great sing along and sure enough she
starts the chords to shame on you. it struck me as so odd to here an ig
song covered. i suppose it happens more often than i'm aware of (didn't
wonder stuff do ctf years ago--still haven't heard their version). she did
a nice rendition which included a cool transition into brown eyed girl and
then back to soy. i suppose all the lalala's brought the 2 songs together.

hi all, [long, skim down to the set list and amy conversation for the short
version]
just back from a great trip to nyc where i went w/friends to see the ct
show. ah, so good to see them again. my friend's b-in-law is on the venue
board so we had front row seats. well, kinda front row--there's a moat
between the stage and the seats, too funny. great show! em, if i recall,
had jeans and a blue button down on and has lost a ton of weight since i
saw them last. amy had on striped pants and a t-shirt and was her usual
beautiful self. it was raining, but that didn't matter once they started.
:) the stage was covered, but open, so one of the funniest parts was when
a *very* large bug dropped down by emily while she was playing. she
stopped and said something about the "bigass bug." sulli came in w/a
tissue to save the day; she picked it up, brought it to the back of the
stage and let it go. there were also bats swooping on the stage at times,
which was very cool. they seemed in good spirits. emily was especially
interactive--she made a lot of eye contact and laughed. amy smiled a bunch,
too, but it was one of her playing w/her eyes closed nights. we wanted to
dance, but weren't allowed, so we yelled up to the stage, "they won't let
us dance." (apologies to the non-dancers--no need to have that discussion
again--lol) emily said some thing like, "it sounds like there's some
oppression going on. come on. given all that's happening in today's
world, people should be able to dance." shortly after, the bouncers (who
were very nice) got word from their walkie-talkies to move back and folks
ran up front. gotta love the girls. crowd danced and sang and things
became much more animated.
my fav: the new stuff. wow--it's been a while since i've heard new stuff
i've liked so much. i totally agree w/the comments indigo lover
made--these are some really amazing new songs.
my one gripe: kim ritchie still doesn't know the words to closer to
fine. even w/the lyrics she messed up. it was funny, actually. and her
two band members, who both looked about 20, played some fierce tambourines
and sang every twentieth word or so. you know, "mountain" "fine." they
looked like they were having a blast and amy laughed at them at the end of
the song and went over and did a mock big finish playing to them. ritchie
redeemed herself on finlandia. i've heard her sing it w/them before and
it's given me chills both times. beautiful. reminds me of the old days
when they'd finish w/mona lisas and mad hatters or simon & garfunckle covers.
preshow tidbits for the diehards: because of my friend, we had a private
tent w/dinner on the lawn before the show and i asked the caterer about the
girls. she said they were incredibly nice (no surprise). she also said
they played a long time--several hours--during sound check and that amy
doesn't drink--which i didn't know-- and they both eat luna bars.
conversation: you had to walk past the buses on the way out of the venue
and amy came out to sign things pretty quickly. she was so cool. she
spent time talking to folks and really listened. i never cease to be
impressed by her laid-back mannerism--it defuses the hero-worship kind of
thing because she's approaches people in such an equal manner. they had
said on stage that the new cd would be out in jan. i asked what their plans
were after that (trying to assuage my fear of a post contract
break-up). she said they wouldn't have to decide for a few years since
they had this cd and then they were still listening to possibilities for
the rarities disc w/russell carter. i asked if they'd made any decision
about going independent and she said no. when i mentioned daemon, she
laughed and said no, that wasn't a possibility. they'd go w/a bigger indy
label if they went that route. she ended by saying "who knows if there'll
even be a sony around by then given all the changes in the industry."
i got a set list. here's the line up:

i missed the chance to go to hampton (i hate the venue and tixs were too
pricey, and newport and suzanne vega are coming right up...)
i know from the ig bbs that shows are already on cdr - i got 500 megs of
server space - and an id on soulseek (which rocks for live show trading a
gazillon times better than any other p2p service - the bootlegs i have
gotten are too numerous...coldplay, radiohead, red house painters, boards
of canada, every minor threat boot, joy division, etc...)
i will be getting tapes of danbury, hampton and calvin theater this
weekend, but since i know i am not the only one who wants these - and i'm
updating my site so it will all be php based - which means not much content
is on there now, so i got a brief window to place a show or two for a few
days...
email me if you can provide mp3's - if you have the cds and a windows
computer - cdex is one of the better ripping programs out there and it is free
anyone heading to nff or suzanne vega @ ll beans (yes the store has
concerts, and the space is nice!) or the national folk fest in bangor maine

i have never been more pissed off in my entire life at an indigo girls
show. it seems the younger the crowd gets the more idiotic they get.
i blogged about it here: htttp://www.dykewrite.com/texasyankee if anyone
cares (there's a picture there...but it's not great quality). i would've
liked to have had a pleasant memory of the ig show but all i can think
about those insolent girls acting like a-holes, starting fights and the
management and ushers doing nothing about it. not to mention that after
the show they thought it would be fun to jump on the stage and try to run
behind the curtain. um, no. don't disrespect the artists, ya know? your
happy asses have no business being on that stage uninvited. and where the
hell do you get off thinking you could get away with that? delusional
little brats...
grrr.. i'm never going to another show again. not until people learn how
to grow up and act decent.
i for one (and my partner for another, and i'm sure our friends that were
there as well) will be writing a complaint letter to the calvin theater and
cc'ing russell carter artist management just to let them know what kind of
lax security they have at these shows.

generalizations about young indigo girls fans - i have been on this list for 10

rightly so) at someone who ruins their concert experience.
however, it is not just the young fans.... while on this particular
occasion, it may have been young girls, i have been to plenty a show with lots of
rude, raucous older fans as well. event though the comment wasnt directed at me,
or probably anyone on this list, i cant help but take some offense, as every
year, people get all pissed off at "the young fans."
i guess i am just asking if you can take your frustrations out in a way that
doesnt necessarily happen to implicate others as well, who have been nothing
but dedicated and respectful fans.

here's what i shared with tracy...thought you'd like to hear a story of
a very good experience, too...
that sucks that you had such an awful experience at an ig show. i just
wanted to share how impressed i was with the general admission crowd at
the hampton beach show on sunday. yeah, there were the usual people
coming to the front of the line just before the doors opened and
disrespecting those of us who had been waiting in line all day but while
waiting inside for the show to begin and during the show i found people
to be so nice and, generally, respectful throughout. the energy was so
high and everyone was singing. yeah, there were people talking in back
during the new songs but i guess not everyone wants to hear every single
word, note and breath of every new song like me! and then afterwards
there were about 50 people waiting for autographs and i swear i didn't
see or hear anyone calling attention to themselves...just waiting
patiently for amy and emily to sign whatever it is they had. that was my
first time waiting for any bus but i was impressed with everyone's
manners and amy and emily were so giving and attentive.

wow! it is amazing how different people view different shows. i attended chautaqua, danbury, hampton beach, and northampton. personally, i was the most disappointed with hampton beach. the security sucked and they did not know how to wand people properly... but i digress.
as far as the noho show goes, i thought that it was the best setlist out of the four. mystery and let it be me in the same show... be still my heart! ;) and both amy and emily seemed so on and so happy! i missed the fight during chickenman, as i was sitting a few rows in front of the fighters (2nd row pit). but i agree that i would have been pissed off had i seen that. i did however see the two people charge up on stage to chase amy and emily. how very rude and immature!
despite the chickenman fight (which i missed) and the girls chasing amy and emily, i thought noho rocked. in fact, it better have! i paid $100 to change my flight ticket back home so i could attend the show! ;)
so far i think this tour has been awesome! i will be curious to read reviews from melody tent tonight. and i'll be seeing some of y'all on monday and tuesday as i am flying back out east from san francisco to hit up baltimore and wolf trap!

barb had it right, for the record. it was a broad generalization but it
wasn't meant to offend those who are ig fans, are respectful and happen to
be young(er than me). i have a tendency to rant and not think about the
innocents who might be offended in the process. :) you have my sincerest

after going to northampton and hyannis this week, i would say that i enjoyed both in very different ways. i won't say which is better, but seating is a key. it's always a treat to sit up front. the seats in the melody tent are all pretty good, but since emily doesn't like the "spinning" of the stage during songs, i saw more of their rears than i expected to, which isn't all bad.
actually, seeing them sing from the side is kind of surreal. i don't know why... i guess i'm so used to seeing them perform facing me. i think being surrounded by all the energy of the crowd really fed amy. she smiled a lot more in hyannis, even though they were pretty hot down on stage by the end of the show. it also seemed to me that they were whipping through the set pretty quickly (maybe also because of the heat). emily looks great. she is definitely thinner, and she looked great before, too.

conductor announced there was a major power outage. it took several
hours to get back home, where we have power. i feel badly for all of
those stuck in nyc. i'm glad i made it home (i have power). i hope
the concert gets rescheduled.

actually, i got a call from a friend in nyc - apparently the igs were =
one of
the few people with a generator, so they went ahead and did ten songs or =
so.

ticketmaster sued in federal court for anti-trust violations
the internationally acclaimed band the string cheese incident, along with
representatives of its ticketing company, sci ticketing, and others,
explained how ticketmaster has monopolized the u.s. concert ticketing
industry.
new york, ny august 11 =e2=80=93 today, members of the rock band the string=20=
cheese
incident, joined representatives of their ticketing company, sci ticketing,
and others at a news conference in new york city to explain the details of a
lawsuit filed in the u.s. federal court in denver, colorado last week.
sci ticketing filed the lawsuit claiming that ticketing giant ticketmaster
has monopolized the ticketing industry, using its immense market power to
prevent competition for the sale of concert tickets. sci ticketing is the
first artist-centered ticketing company to sue ticketmaster in federal
court.
sci ticketing is owned by the string cheese incident and their management
company, madison house inc., based in boulder, colorado. madison house is a
management and booking agency that was started in 1996 with the vision of
centralizing all of the music industry=e2=80=99s individual functions. sci
ticketing is one of the =e2=80=9cfamily of businesses=e2=80=9d located in th=
e madison
house/string cheese headquarters.
according to neil l. glazer, an attorney at the philadelphia law firm, kohn
swift and graf, p.c., who is leading the team of lawyers representing sci
ticketing in the lawsuit, sci ticketing =e2=80=9chad no other recourse than=20=
to take
legal action.=e2=80=9d
=e2=80=9csci ticketing has literally hit the wall in terms of being able to=20=
sell
tickets directly to fans because of ticketmaster=e2=80=99s anticompetitive
practices,=e2=80=9d glazer said. =e2=80=9cour client has carved out a truly=
unique and
successful way to do business. unfortunately, they simply cannot compete
because ticketmaster is restricting the supply of concert tickets.=e2=80=9d
because ticketmaster has exclusive dealing arrangements with so many venues
and promoters, they have closed out independent, artist-driven ticketing
companies like sci ticketing. this has made it increasingly difficult for
madison house to book bands such as the string cheese incident, who feel
strongly about having the right to sell an allotment of their tickets
directly to fans.
glazer said that the antitrust violations alleged in the suit include:
=c2=b7 ticketmaster has entered into combinations, agreements, or conspir=
acies
with promoters, venues and others, in restraint of trade, in violation of
section 1 of the sherman antitrust act.
=c2=b7 ticketmaster has monopolized, attempted to monopolize, or abused i=
ts
monopoly power in the market for the sale of tickets to popular music
concerts, in violation of section 2 of the sherman antitrust act.
in addition, sci ticketing asserts a state law claim for tortious
interference with prospective business advantage.
=e2=80=9cthe decision to file this lawsuit was not one taken lightly,=e2=80=
=9d glazer added.
=e2=80=9csci ticketing is a very small company, and ticketmaster is one of t=
he
behemoths of the concert industry. by filing this lawsuit, sci ticketing is
hoping to put a stop to anticompetitive practices that harm not only
innovative young companies, but also artists and consumers.=e2=80=9d
mike luba, co-founder of sci ticketing and a partner in madison house inc.,
believes that being able to compete in the concert ticketing industry is
critical to his organization=e2=80=99s creative and business philosophy. =20=
=e2=80=9cfor bands
like the string cheese incident, who depend on heavy touring and lasting fan
relationships in order to succeed, services like direct artist-to-fan
ticketing are essential. it allows fans to enjoy the complete string cheese
experience, from beginning to end,=e2=80=9d luba said. =e2=80=9cthis involv=
es giving the
fans unprecedented attention for the essential part they play in the artists
=e2=80=99 career, and being able to offer fans sci performances in high qual=
ity
venues and with affordable prices. today, cultivating an artists=e2=80=99 f=
an base
through such things as touring, creative internet communications, and how
they sell tickets are some of the ways for bands to survive outside the
music industry=e2=80=99s corporate machine. bands like the string cheese in=
cident
rely on these tools for survival,=e2=80=9d he added.
keith moseley, bassist/vocalist of the string cheese incident, said the band
has aligned sci ticketing with their creative vision to fulfill a life-long
dream. =e2=80=9cits been a huge commitment =e2=80=93 our touring and reinve=
sting and
sacrifice,=e2=80=9d said moseley. =e2=80=9cwe hope this action sends the me=
ssage loud and
clear that monopolies like ticketmaster cannot and will not be the only game
in town; our fans deserve more than that.=e2=80=9d
=e2=80=9cwe are not saying ticketmaster doesn=e2=80=99t have a place in the=20=
ticketing
business, but we have a different philosophy of doing business, one that
caters more directly to our fans,=e2=80=9d said jason mastrine, general mana=
ger of
sci ticketing. =e2=80=9cnow, for the first time in our company=e2=80=99s his=
tory,
ticketmaster is preventing us from acquiring the same reasonable ticket
allocations we used to get from promoters and venues. there=e2=80=99s room=20=
for
everyone in the mix.=e2=80=9d
according to luba, the music industry is changing dramatically with many
artists wanting to take more control of their own careers. =e2=80=9cthis in=
volves
everything from the labels they choose to who does their ticketing,=e2=80=
=9d luba
continued. =e2=80=9cbut it=e2=80=99s not just about artists wanting to cont=
rol their own
destiny and providing better service to their fans, it=e2=80=99s also an eco=
nomic
issue. for many artists in today=e2=80=99s music industry, touring has beco=
me a
much more important source of revenue than record sales because constant
touring encourages community building and fan loyalty, which promotes a
sustainable career.=e2=80=9d
=e2=80=9cthe music industry is suffering right now, but there is no reason t=
hat the
artists and their fans have to go down with it. we hope that the positive
ramifications of filing this lawsuit
will reach well beyond just the string cheese incident and their fans, and
